The investigator has many different functions in preparing for a Criminal Defense. An investigator must review and verify the evidence and statements taken by Law Enforcement personnel. Because a lot of times Law Enforcement targets just one suspect and then attempts to fit the evidence and information in a light that is most harmful to the defendant.
A Criminal Defense Investigator must seek out and identify new witnesses as they may provide new information or evidence that refutes the prosecutions case. The investigator needs to determine if the witness is truthful and has the kind of image , that will not hurt the defense , if he / she would be called to testify. The investigator should do a background check on a potential witness to see if their is any physical or mental condition that could be used to substantiate or diffuse their testimony.
